JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-09-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the complainant is languishing in jail since 10.03.2016 in a case registered for the offences punishable under Section 498A of the Indian Penal Code. The basic accusation is of torture.

It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the complainant. At earlier point of time in the year 2009, the complainant lodged Complaint Case No. 750 of 2009 levelling accusation under Section 498A of the IPC wherein the petitioner has been acquitted vide judgment dated 04.01.2011 passed by learned SDJM, Bagaha and thereafter in the year 2013, the petitioner filed Matrimonial Suit No. 113 of 2013 for restitution of conjugal right but now the petitioner is not ready to keep the complainant. Considering the nature of accusation and the fact that investigation has already concluded, let the above named petitioner, be released on bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned JM, 1st Class, Bagaha (West Champaran) in connection with Complaint Case No. C/1308 of 2013.
