The petitioner has been made accused in Rajoun P.S,Case No.165 of 2016 (G.R.No.1705 of 2016) for the offence under Section 363, 366 (A)/34 of the IPC.

It is submitted on behalf of the petitioner that the petitioner is own brother-in-law of the victim girl and the informant is the father-in-law of the victim girl. The victim girl has stated under Section 164 Cr.P.C. that she had gone on her own sweet will and the petitioner is in custody since 7.7.2016. Heard learned A.P.P. also.

Having heard both sides and in view of the facts as stated above as well as considering the statement of the victim girl

Patna High Court Cr.Misc. No.49442 of 2016 (3) dt.14-12-2016 2/2 under Section 164 Cr.P.C., let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Banka in connection with Rajoun P.S.Case No.165 of 2016 (G.R.No.1705 of 2016).
