JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bhawanipur (Akbarpur) P.S. Case No. 162 of 2018 registered for the offences punishable under Sections 353, 387, 504/34 of the Indian Penal Code.

The accusation against the petitioner is that he along with others went to the school of informant and pressurized him to show the attendance register and when informant refused to show the attendance register, petitioner and his associates demanded extortion money and misbehaved with the informant. However, it is submitted that there is case and counter case between the parties and as a matter of fact, petitioner had

Patna High Court Cr.Misc. No.67576 of 2018(2) dt.06-12-2018 2/2 gone in search of a teacher who used to teach his daughter but the informant of the present case humiliated and assaulted him for which he lodged Bhawanipur (Akbarpur) P.S. Case No. 161 of 2018. It is informed that both the parties have already entered into compromise.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st , Purnea in Bhawanipur (Akbarpur) P.S. Case No. 162 of 2018, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
