The petitioner prays for bail in Janki Nagar P.S. Case No. 42 of 2016 registered under section 302/34 IPC. It is alleged that the petitioner assaulted the son of the informant on his head with Danda. There is further allegation that other accused persons thereafter assaulted him. Counsel for the State points out from the case diary that a grievous injury was found on the head of the victim, as a result where he died while being carried to the hospital, as alleged in the FIR.

It is stated that the petitioner is in custody since 09.05.2016 having no murky past.

Considering the allegation and the corresponding injuries

Patna High Court Cr.Misc. No.43830 of 2016 (4) dt.30-11-2016 2/2 found by the doctor while holding/conducting the autopsy on the cadaver as also the period of incarceration, I am not inclined to extend the petitioner the privilege of bail. Prayer is accordingly rejected for the present.
