The case is under Section 47A of the Excise Act and the recovery is of 140 bottles each of 180 ml. of Mcdowell brand of foreign liquor.

Regard being had to the nature of the content of the bottles and its illegal possession, it does not appear a fit case for grant of anticipatory bail to the above named petitioner. The same is dismissed.

However, let the petitioner surrender before CJM, Jamui in Chakai P.S.Case No.11 of 2013 and pray for regular bail which shall be considered without being prejudiced by any order of rejection under Section 438 Cr.P.C.
