JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-11-2018 The petitioner seeks regular bail in connection with Araria (Mahila) P.S. Case No. 66 of 2018, registered for offences punishable under Sections 341, 323, 3376, 504, 506/34 of the Indian Penal Code.

Allegation as per F.I.R. is that co-accused persons taken the victim girl and committed rape on her and allegation against the petitioner is that he provided shelter to the coaccused persons. It has been submitted on behalf of the petitioner he is not named in the F.I.R, he has been made accused in this case only on the basis of confessional statement of co-accused and except that there is nothing against the petitioner. Further, there is no allegation against the petitioner is of establishing

Patna High Court Cr.Misc. No.65517 of 2018(2) dt.22-11-2018 2/2 physical relationship with the informant. It has also been submitted that petitioner has no criminal antecedent and has been in judicial custody since 8.8.2018.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Araria, in connection with Araria (Mahila) P.S. Case No. 66 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
