JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307 and 504/34 of the Indian Penal Code.
It is alleged that the petitioner assaulted with lathi on the head of the informant.
It is submitted by learned counsel for the petitioner that the injury report as contained in Annexure-3 reflects one incise injury on occipital region of the scalp simple in nature caused by sharp cutting weapon whereas other injury is bruise and body ache. It is further submitted that petitioner filed Jhajha P.S. Case No. 21 of 2015 against the informant prior to the lodging of the present case.
Considering the fact that the accusation is not being

No.27604 of 2015 (3) dt.30-07-2015 2/2 corroborated by the medical opinion as the petitioner alleged to have assaulted with lathi whereas incise injury has been found by the doctor, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jamui in connection with Jhajha P.S. Case No. 24 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
