The petitioner seeks bail in a case registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 and under Sections 272, 273 and 120(B)of the IPC.
It is contended that, as per allegation, huge quantity of liquor was recovered from the truck, motorcycle, Dalan and house of co-accused, Sunil Singh. It is further contended that nothing was recovered from the conscious possession of the petitioner and he has falsely been implicated in this case. It is further urged that other co-accused, Sunil Singh & others have already been granted anticipatory bail by this Court vide order
Patna High Court Cr.Misc. No.62698 of 2018(2) dt.08-10-2018 2/2 dated 06.09.2018 passed in Cr. Misc. No.53052 of 2018, as contained in Annexure 2. Petitioner claims that he is having clean antecedent and is in custody since 27.06.2018. Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge VII - cum - Spl. Judge Excise, East Champaran at Motihari in connection with Piprakothi P. S. Case No. 107/18.
Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
