The petitioner although not named in the FIR registered under section 392 IPC against unknown, but from the materials on record, it appears that he was apprehended with a stolen sim card.

It is submitted that there is a delay of 02 days in lodging the FIR. The FIR is against unknown. The petitioner is in custody since 30.05.2016 having only one case of minor nature lodged by the Gotia.

Learned APP, on the other hand, submits that apart from the criminal antecedents, the petitioner was apprehended with the stolen articles which is/are the subject matter of robbery in the case.

Patna High Court Cr.Misc. No.48420 of 2016 (2) dt.01-12-2016 2/2 This Court finds from the observation made by the learned Sessions Judge in the order that he has been granted liberty to renew his prayer for bail after charge. Considering the above, this Court does not find it a fit case for grant of bail to the petitioner. Prayer is accordingly rejected.
