The petitioner is apprehending his arrest in connection with Civil Lines P.S. Case No. 181 of 2015 for the offences instituted under Sections 341, 323, 379, 387 and 504/34 of the IPC.
The prosecution story, in brief, is that the petitioner firstly made entry into the shop of the informant through prime tenant of that shop and in pretext of vacating the same called the informant to his house and with the help of two other accused persons asked to prepare the paper of Kirayanama in his favour
Patna High Court Cr.Misc. No.27327 of 2015 (3) dt.09-09-2015 2/2 and when the informant denied to do so then showing the threat of pistol obtained the signature and thumb impression on different blank papers in order to use the same for their wrongful gains. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. From perusal of the F.I.R. itself it is evident that the present dispute is between the landlord and the tenant and for the said reason the petitioner has falsely been implicated in the present case.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Civil Lines P.S. Case No. 181 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
