The petitioner is apprehending his arrest in a case instituted under Sections 419, 420 and 120B of the Indian Penal Code.

The prosecution case, in short, is that the petitioner on the basis of forged and fabricated agreement regarding land of the informant is negotiating from people to sell the land of the informant and also taking money in advance. On hearing such and seeing an agreement containing his forged signature, the informant tried to contact the accused but he is absconding. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The matter is of the

Patna High Court Cr.Misc. No.28631 of 2015 (3) dt.01-10-2015 civil dispute. The petitioner has been made accused due to mistake of fact. It is further submitted that the petitioner is ready to deposit an amount of Rs.15,000/- in the court below, which shall be subject to the final disposal of the case.

On behalf of the State, it is submitted that the petitioner is named in the first information report. Considering the aforesaid facts, it is directed that the petitioner shall deposit an amount of Rs.15,000/- in the court below, which shall be subject to the final disposal of the case, within a period of four weeks from today.

Let the petitioner, above named, in the event of his arrest/surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Town P.S. Case No.71 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
