JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,504 and 302 of the Indian Penal Code.
It is alleged that the husband of the informant informed the informant that he is being assaulted by petitioner. The petitioner admitted through mobile that he assaulted the informant's husband for not returning eight thousand rupees taken as loan. Subsequently, the dead body of the husband of the informant with legs and hands tied was recovered. It is submitted by the learned counsel for the petitioner that there is no eye witness to the occurrence and only on suspicion the accusation has been levelled. It is further submitted
Patna High Court Cr.Misc. No.33075 of 2015 (2) dt.11-08-2015 2/2 that call detail report has not been obtained by the I.O. and the accusation is based on the basis of message received by the informant through mobile. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Didarganj P.S. Case No. 33 of 2015 pending in the court of learned J.M. Patnacity. This application is disposed of with the aforesaid observation/direction.
