The petitioner is accused in connection with Bihariganj P.S. Case No. 72 of 2018 registered under Sections 323, 341, 307, 379, 504 and 506/34 of the Indian Penal Code. The accusation is that due to quarrel in between son of the informant and son of his neighbour, seven persons named in the F.I.R. including the petitioner having lathi, danda, bricks, stones and iron rod came at the door of the informant raising Halla. When the informant came out from his house then they started to commit Marpit, in which, he sustained injury at his head. In the meantime, they also snatched two mobiles and cash of Rs.5000/- from his pocket.

No.62453 of 2018(2) dt.08-10-2018 2/2 Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to dirty village politics as petitioner is the co-villager of the informant. Further submission is that while petitioner is named in the F.I.R. along with six others but no specific overt act has been attributed against him. It is further submitted that petitioner has no criminal antecedent and is in custody since 25.06.2018. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Udakishanganj, Madhepura, in connection with Bihariganj P.S. Case No. 72 of 2018. Out of two sureties, one surety must be the close relative of the petitioner.
