JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 15-11-2017 This application has been filed for initiating action for contempt on account of non-compliance with certain orders passed by this Court on 23.09.2010 in L.P.A. No. 635 of 2003 and modification in the Circular dated 29.07.2011. Now, after such a long period of time, we see no reason to make any indulgence into the matter and order for

Patna High Court MJC No.1987 of 2012 dt.15-11-2017 2/2 modification in the Circular issued on 29.07.11. It appears that with the passage of time, no one is interested to prosecute the case, as after filing of this application in the year 2012, more than four years have passed but the defects as pointed out by the office have not been rectified. When the matter is taken up today, none is present to prosecute the case.

In case, the petitioner has any grievance still subsists and law permits, petitioner is granted liberty to initiate fresh proceeding, in accordance with law.

With the aforesaid, the application stands disposed of.
