Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 304B and 316 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioners, being distantly related to the husband of the deceased, have been falsely implicated in the instant case by the informant. It is next submitted that the informant alleges that his daughter was married to Bablu Yadav about three years ago and out of wedlock, a child was born, but after marriage, the accused

No.59794 of 2024(4) dt.22-01-2025 2/3 persons including the petitioners used to abuse and assault the daughter of the informant, and on 15-3-2024, it is alleged that Bablu Yadav along with Sadhu, Sunil Yadav and Guddu Yadav in a drunken condition brutally assaulted the daughter of the informant and killed her, when she was carrying a nearly nine months pregnancy.

Learned counsel for the petitioners submits that Bablu Yadav was married for the second time to Gulabi Devi and Sunil Yadav is husband of the sister of Gulabi Devi and Manju Devi is sister of Gulabi Devi, while Gulabi Devi is the second wife of Bablu Yadav, and Guddu Yadav is brother of Gulabi Devi. It is next submitted that since Bablu performed his second marriage with Gulabi Devi, as such the petitioners came to be implicated with general and omnibus allegation. It is further submitted that informant is not an eye witness to the occurrence and the entire allegation hinges around suspicion and husband of the deceased is in custody.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court
Patna High Court CR. MISC. No.59794 of 2024(4) dt.22-01-2025 3/3 within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Jhajha P.S. Case No. 115 of 2024 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
