JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 17-11-2022 Learned counsel for the petitioner undertakes to remove the defects within a period of two weeks from today. Heard learned counsel for the petitioner and Mr. Anil Kumar, learned AC to SC-8 for the State.

This writ application has been filed seeking proper investigation of Dalsinghsarai P.S. Case No. 209/2020 registered for the offence under Section 386/34 of the Indian Penal Code. Learned counsel for the petitioner submits that he is only looking for impartial investigation of the case. In this regard,

Patna High Court CR. WJC No.1155 of 2022(2) dt.17-11-2022 2/2 his wife has also filed a representation which will be evident from Annexure '3' to the writ application. It is submitted that the efforts of the petitioner to request the investigating agency to conduct investigation of the case from different angles, has not been given heed to.

Learned counsel for the State submits that in the given facts and circumstances an appropriate directions may be issued to the Superintendent of Police, Samastipur (respondent no. 5). Having regard to the facts and circumstances of the case, this Court directs the respondent no. 5 to supervise the case personally and all efforts be made to find out the truth upon conducting investigation from all the angles. In the process the materials brought to the notice of the investigating agency by the petitioner may also be examined.

It is expected that respondent no. 5 shall upon proper examination of the materials issue necessary instruction to the I.O. or any other supervising authority to conclude the investigation within a reasonable time and file a police report.
