Petitioner, who is in custody, seeks bail in connection with Bakhri P.S. Case No. 287 of 2015 registered for the offences punishable under Sections 341, 323, 324, 506, 307 and 379/34 of the Indian Penal Code and under Section 27 of Arms Act.
Informant has alleged that while he was going on motorcycle with his son FIR named three accused intercepted their motorcycle and all of them started firing on him and he received two firearms injuries on the right armpit and left armpit. It has been alleged that due to land dispute accused Ram Charitra Mahto tried to kill him and his son. It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has falsely
Patna High Court Cr.Misc. No.68254 of 2018(2) dt.29-11-2018 2/2 been implicated in this case. He is not related with Ram Charitra Mahto and has been falsely implicated in this case. It has been further submitted that Ram Charitra Mahto has been granted bail by another co-ordinate Bench of this Court in Cr. Misc. No. 13182 of 2018 vide order dated 11.05.2016. He is in custody since 18.08.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 5th, Begusarai in connection with Bakhri P.S. Case No. 287 of 2015.
