JUSTICE RAKESH KUMAR ORAL ORDER 15-12-2016 Heard Sri Anish Kumar, learned counsel for the petitioner and Sri Madan Kumar, learned Addl. Public Prosecutor. Two petitioners, who are in custody since 14-05-2016 in Motipur P.S. Case No. 133 of 2016 registered for offence under Sections 399, 402, 414 of the Indian Penal Code, Sections 25(1-b)a, 26(ii), 35 of the Arms Act, 1959 and Sections 20 & 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985, have prayed for grant of bail.

It was submitted by learned counsel for petitioners that petitioners have falsely been implicated in the present case. However, on perusal of the F.I.R., it is evident that on secret information, a raid was conducted and thereafter, four

Patna High Court Cr.Misc. No.44331 of 2016 (2) dt.15-12-2016 2/2 accused persons, including petitioners, were apprehended, however; one accused person succeeded in fleeing away. From possession of the accused persons, country-made pistol, cartridges besides sedative drugs were recovered.

Considering the seriousness of the accusation, I do not find any ground to grant bail.

Dismissed.
