JUSTICE SUDHIR SINGH ORAL ORDER 22-07-2015 The petitioners are apprehending their arrest in connection with Rivilganj P.S. Case No. 14 of 2015 for the offences instituted under Sections 147, 148, 149, 353, 352, 283, 504, 290, 307, 337 and 338 of the Indian Penal Code. Heard learned counsel for the petitioners and learned counsel for the State.
The prosecution story, in brief, is that on 30.01.2015 two groups were fighting to each other for disposal of the idol of Goddess Saraswati and when the Police tried to pacify the same, the accused persons pelted stones which caused injury to the Police officials.
It has been submitted on behalf of the petitioners that altogether 14 persons are said to have been named in the first
Patna High Court Cr.Misc. No.27919 of 2015 (2) dt.22-07-2015 2/2 information report. It is further submitted that there is no specific allegation against the petitioners for causing injury to anyone. It is further submitted that the co-accused persons have already been granted anticipatory bail by this Court vide Cr. Misc. No. 17304 of 2015.
On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of arrest or surrender before the learned court below within a period of six weeks from today in connection with Rivilganj P.S. Case No. 14 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
