The petitioner seeks bail in Muffasil P.S. Case No. 209 of 2015, registered for the offence punishable under Section 395 of the Indian Penal Code.
The informant alleged that he was going with a pick-up van loaded with cattle towards Sanda cattle animal fair. The accused persons who were on Safari vehicle came in front of the vehicle of the informant near Chatra More. The accused persons looted Rs. 5,96,000/- from the informant and other traders. Learned counsel for the petitioner submits that the petitioner is not named in the FIR. Nothing has been recovered from possession of the petitioner. Name of the petitioner figured in the case in the confessional statement of Amarjit Kumar recorded
Patna High Court Cr.Misc. No.42217 of 2016 (3) dt.06-12-2016 2/2 in paragraph-67 of the case diary and thereafter the petitioner was arrested on 27.07.2016. Since then the petitioner is in jail but he has not been put on test identification parade as yet. It appears that save and except the confessional statement of the co-accused, there appears no tangible material against the petitioner.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Muffasil P.S.
