Heard the learned counsel for the petitioner and learned APP for the State.
The petitioner apprehends his arrest for the offences alleged under Sections 379, 411, 413, 414 and 420 of the Indian Penal Code, registered in connection with Korha P.S.Case No.239 of 2020.
Learned counsel for the petitioner has submitted that the allegation against the petitioner is that he along with other accused persons were indulged in motor-cycle theft. He has further submitted that the name of the petitioner figured in the
Patna High Court CR. MISC. No.9058 of 2021(2) dt.21-12-2021 2/2 confessional statement of a co-accused and no recovery was made from the possession of the petitioner. He has also submitted that the learned Sessions Judge has granted anticipatory bail to four accused persons on similar allegation in ABP No 706 of 2020, vide order dated 05.09.2020 as well a ABP No.1132 of 2020, vide order dated 01.10.2020. Considering the above-mentioned facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar in connection with Korha P.S.Case No.239 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
