The petitioners seek regular bail in connection with Dalsinghsarai P.S. Case No. 70 of 2019 for the offences punishable under Sections 304(B)/34 of the Indian Penal Code. The present case arises out of the allegation by the prosecution to the effect that the accused persons including the petitioners herein had done away the victim lady on account of non-fulfillment of the demand for dowry.
The learned counsel for the petitioners submits that the petitioner no.2 has already been granted bail by earlier order dated 02.08.2019 passed by this Court and as far as the
Patna High Court CR. MISC. No.47647 of 2019(3) dt.30-09-2019 2/2 petitioner no.1 is concerned, he is the Bhaisur (elder brother-inlaw) of the deceased victim lady. It is apparent from the record that the petitioner no.1 is staying apart from the family of the deceased lady and he has got no connection whatsoever as far as sharing of the household with the victim lady or her husband is concerned. It is submitted that the petitioner No.1 is having a clean antecedent and is languishing in custody since 26.05.2019. Having regard to the facts and circumstances of the case, the petitioner No.1, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Dalsinghsarai in connection with Dalsinghsarai P.S. Case No. 70 of 2019.
