The application is for grant of bail for the offence under Section 273 of the Indian Penal Code and Section 47 of Bihar Excise (Amendment) Act, 2016.
Allegation against the petitioner is of recovery of 8 litres of country made liquour from the house of the petitioner. It has been submitted on behalf of the petitioner that nothing has been recovered from possession of the petitioner rather it has been recovered from the house of the petitioner. She has no criminal antecedent and she is in custody since 11.09.2016. Heard learned A.P.P. also.
Having heard both sides and in view of the fact that
Patna High Court Cr.Misc. No.55001 of 2016 (2) dt.22-12-2016 2/2 the petitioner is in custody for about two months and she has no criminal antecedent, let petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Kishanganj in connection with Dighalbank P.S. Case No. 84 of 2016 (G.R. No. 1508 of 2016).
