The petitioner seeks bail in connection with Sonbarsa P.S. Case No. 340 of 2021 dated 04.12.2021 instituted for the offences under Sections 395 & 397 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner has not been named in the F.I.R. in which several persons have been made accused. His name has transpired in the confession of one Bhola Sah who has now been granted bail. Apart from the confession, there is no other material to connect the petitioner with the offense. Nothing incriminating also has been recovered from his possession.

Patna High Court CR. MISC. No.52294 of 2022(2) dt.23-12-2022 2/2 With respect to the criminal antecedent of the petitioner, learned counsel submits that the petitioner was made accused in one case and thereafter he has been remanded in all other cases.

The petitioner is stated to have been granted bail in all other cases.

In this case, the petitioner is in custody since 19.04.2022.

Regard being had to the aforesaid facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Sonbarsa P.S. Case No. 340 of 2021.
