====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 18-09-2019 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 413/34 of the Indian Penal Code and Sections 8/20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

About 38 Kg. of Ganja was allegedly recovered from possession of the petitioner. Petitioner is in custody since 08.10.2016.

Earlier twice prayer for bail was refused by this Court. Firstly on 14.07.2017 in Cr. Misc. No. 22163 of 2017 and again on 12.12.2018 in Cr. Misc. No. 58967 of 2018 and both the time, the trial Court was directed to expedite the trial. However,

Patna High Court CR. MISC. No.57489 of 2019(2) dt.18-09-2019 2/2 trial has not concluded as yet.

Considering the period already undergone as under trial prisoner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Special Case No. 77 of 2016 arising out of G.R.P. Patliputra Junction Police Station Case No. 13 of 2016, subject to the following conditions:- (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
