====================================================== CORAM: HONOURABLE MR. JUSTICE MADHURESH PRASAD ORAL ORDER 06-10-2018 Heard learned Counsel for the petitioners and the learned Counsel for the respondent State.
The petitioners have challenged order dated 20.10.2012 rejecting their claim for regularisation. Counsel for the petitioners submits that the claim was made pursuant to the order dated 12.4.2012 passed in the earlier
Patna High Court CWJC No.16244 of 2014(2) dt.06-10-2018 2/2 writ petition (CWJC No. 7299 of 2012). The petitioners claim to be working in the Bhagalpur Central Cooperative Bank between 1986 to 1989.
The claim of the petitioners has been considered by the Administrator of the Bank and a reasoned and speaking order has been issued on 20.10.2012. The Bank has rejected the petitioner's claim based on the policy decision of the State Government under Circular No. 1534 dated 3.6.2006 regarding regularisation of the daily wage employees in the Government. The order is to the extent that the decisions of the State Government are not applicable to the Cooperative Societies and the petitioners cannot assert any right on the basis of such decision of the State Government which at best can only apply to the State authorities.
This Court does not find any infirmity with the decision taken by the respondents under order dated 20.12.2012. The writ petition is accordingly dismissed.
