Petitioner, who is in custody, seeks bail in connection with Bettiah Town P.S. Case No. 337 of 2017 registered for the offences punishable under Sections 302, 120B and 34of the Indian Penal Code. Informant who is the police officer has alleged that when he was coming after production of trial prisoner Bablu Dubey from the court in the mean time some unknown criminal fired upon Bablu Dubey and fled away as a result of which he fell down and died in the course of treatment. It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been
Patna High Court Cr.Misc. No.62985 of 2018(2) dt.26-10-2018 2/2 falsely implicated in this case only on suspicion. Nothing has been recovered from the possession of the petitioner. Name of the petitioner has surfaced in this case only on confessional statement of co-accused Kunal Singh and except this confession there is nothing against the petitioner. He is in custody since 02.02.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Bettiah Town P.S.
