====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 28-08-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Mokama P.S. Case No. 76 of 2019, instituted for the offence under Section(s) 25(1b)a, 26 and 35 of Arms Act. It is alleged in the written report that informant on getting information that some criminals having arms have assembled at Ishwar Tola, Mokama, Ghat, he along with Police personnel reached there. On seeing the Police party, three persons started running away. Two persons were apprehended by the Police and one managed to run away. The apprehended persons disclosed their names as Ritesh Kumar and Ajay Kumar (petitioner). On search, one country made pistol loaded with two

Patna High Court CR. MISC. No.52390 of 2019(2) dt.28-08-2019 2/2 cartridges has been recovered from possession of co-accused Ritesh Kumar whereas 3 live cartridges have been recovered from possession of the petitioner.

Counsel for the petitioner submits that co-accused Ritesh Kumar has already been granted bail by coordinate Bench of this Court vide order dated 29.7.2019 passed in Cr. Misc. 46613 of 2019.

Petitioner is in custody since 24.4.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Manoj Kumar, learned Judicial Magistrate, 1st Class, Barh, Distt. Patna, in connection with Mokama P.S. Case No. 76 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
