JUSTICE SUDHIR SINGH ORAL ORDER 24-07-2015 Heard learned counsel for the petitioners as well as learned counsel for the State.

In this application for anticipatory bail the petitioners apprehend their arrest for the offences punishable under section 306/34 of the I.P.C The prosecution story, in brief, is that one Subash Choudhary gave a written report to the police on 10.03.2015 to the effect that his married daughter Punam Devi has committed suicide in his house die to torturous behaviour of the accused persons.

It is submitted on behalf of the petitioners that

Patna High Court Cr.Misc. No.28854 of 2015 (2) dt.24-07-2015 2/2 petitioner no.1 is the father-in-law, petitioner no.2 is mother-inlaw, petitioner no.3 is Dever of the deceased, petitioner no.4 is brother-in-law of the deceased and petitioner no.5 is also brotherin-law of the deceased. It has further been submitted on behalf of the petitioners that petitioners have got no criminal antecedents. The petitioners have not played any role in respect to the offence as alleged. It is further submitted that from perusal of Annexure-2 it would appear that the deceased had died in the house of her parents, in respect to that a case was filed by the accused side. On behalf of the State, it has been submitted that the petitioners are named in the FIR.

Considering the aforesaid facts and circumstances, the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. C.J.M. Aurangabad in Barun P.S. Case No. 38 of 2015, subject to the conditions as laid down in section 438 (2) of the Cr.P.C. (Sudhir Singh, J) Abhay/- U T
