It appears that this court has refused prayer for anticipatory bail to the petitioners by order dated 28.06.2017 in Cr. Misc. No. 49697/2016 in connection with Belhar P.S. Case No. 141/2016.
Prayer has been renewed on the ground that subsequent thereto some other co-accused were allowed anticipatory bail by two different Coordinate Benches of this court, vide order contained in Annexure-5 and Annexure-6. The grant of anticipatory bail to some other coaccused by some other Coordinate Bench would not be a ground to review the prayer of the petitioners in absence of the material
Patna High Court Cr.Misc. No.64069 of 2018(2) dt.09-01-2019 2/2 that order of this Court was considered by the said courts. The argument of the petitioners that the petitioners are family members and living separately has already been considered in the earlier order.
Considering the aforesaid facts, I am not inclined to entertain the review petition in the matter of prayer for anticipatory bail. As such this application is dismissed with cost of Rs. 1000/- to be deposited in the victim compensation fund. The court below is directed to take coercive step for apprehension of the petitioners.
