Mr. Binod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 16-02-2022 Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State through video conferencing.

At the very outset, the learned counsel for the petitioners has submitted that during the pendency of this criminal miscellaneous petition, Sangita Devi (petitioner no.1) has been arrested, as such, this criminal miscellaneous petition has become infructuous with respect to her.

In view of above submission, this criminal miscellaneous petition is dismissed as infructuous with respect to petitioner no.1.

So far as petitioner no. 2 is concerned, he apprehends

Patna High Court CR. MISC. No.9039 of 2021(3) dt.16-02-2022 2/2 his arrest in connection with Sarai P.S. Case No. 36 of 2020 registered for offence punishable under sections 341, 323, 324, 307, 354/34 of the Indian Penal Code.

The learned counsel for the petitioner has submitted that so far as petitioner no. 2 is concerned, the allegation against him is that he assaulted the informant on his head. The injury report shows that the informant Rajendra Prasad Singh sustained only one abrasion on his scalp, which is simple in nature caused by hard and blunt substance. The learned counsel has further submitted that there is land dispute and case and counter case. Considering the above mentioned facts and circumstances, let petitioner no. 2, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-17, Vaishali at Hajipur in connection with Sarai P.S. Case No. 36 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.
