JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419,420,379,411,414 and 401/34 of the Indian Penal Code.
Two persons were apprehended while making preparing for cheating the innocent people at Muzaffarpur railway station. The apprehended accused disclosed the name of the petitioner. One motorcycle was recovered from the place of occurrence which was initially suspected to be of co accused Manoj Gupta but subsequently on verification from the District Transport Office, the owner of the motorcycle was found to be of one Shant Lal Sharma.
It is submitted by the learned counsel for the petitioner
Patna High Court Cr.Misc. No.27752 of 2015 (2) dt.23-07-2015 2/2 that except confession of apprehended accused, nothing has been collected during investigation against the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Moreover, similarly situated co accused Manoj Gupta has been granted anticipatory bail vide Cr. Misc. No. 2938 of 2015.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Sonepur in connection with Muzaffarpur Rail P.S. Case No. 31 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
