JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 302 IPC and Section 3(2)(v) of SC/ST (POA)Act.
The prosecution story, in brief, is that the informant got information that his nephew died on account of electric current by live electric wire which has fallen in the land. It is further alleged that the petitioner had put Toka in the electric pole and had kept the live electric wire all around the field of maize crops without any information to the villagers.The deceased was going for call of nature through that rasta and as soon as he entered into maize field of the petitioner, he got electric shock and died. It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.27955 of 2015 (2) dt.23-07-2015 2/2 land belongs to one Birendra Prasad where the deceased is said to have received electric shock. The petitioner has got no concern with the said land.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Sitamarhi in connection with Majorganj ( Suppi) P.S.Case no. 91/2015, subject to the conditions as laid down u/s 438(2) Cr.P.C. (Sudhir Singh, J) singh/- U T
