JUSTICE SANJAY PRIYA ORAL ORDER 31-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Kaluahi P.S. Case No. 69 of 2018 instituted for the offence under Section 376 (D) of the Indian Penal Code and Section 4/6 of POCSO Act. In the written report it is alleged that 11 years old daughter of the informant was raped by the petitioner along with co-accused Atul Singh.
The victim girl has given statement under Section 164 Cr. P.C. which supports the case of prosecution. The medical report of the victim girl also supports the case. In such circumstances, this Court is not inclined to grant bail to the petitioner at this stage.
Prayer for bail of the petitioner stands rejected.
Patna High Court Cr.Misc. No.64589 of 2018 (2) dt.31-10-2018 2/2 Trial Court is directed to expedite the trial and make efforts to conclude the same as early as possible preferably within a period of nine months.
