JUSTICE SANJAY PRIYA ORAL ORDER 06-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bettiah Muffasil P.S. Case No. 113 of 2018 instituted for the offence under Sections 30(A), 31, 35, 38, 41 and 56(1) of the Bihar Prohibition and Excise Act, 2016.
From the seizure list it appears that huge quantity of foreign liquor has been recovered from the Ambulance kept in 118 cartons. The petitioner was driver of the aforesaid Ambulance. The petitioner has disclosed that aforesaid liquor belongs to Balwant Ji and Brajesh Kumar and they were staying in Kajal International Hotel. The police along with the petitioner raided the Hotel, but they have managed to run away.
Patna High Court Cr.Misc. No.66914 of 2018 (2) dt.06-11-2018 2/2 Considering the huge quantity of liquor has been recovered from the Ambulance in which the petitioner was driver, this Court is not inclined to grant bail to the petitioner at this stage. Prayer for bail of the petitioner stands rejected. Petitioner may renew the prayer for bail after six months.
