JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406,429 and 420 of the Indian Penal Code.

It is alleged against the petitioner that the petitioner took Rs.63,500/- from the informant to revive LIC policy but the petitioner neither handed over receipt nor the money was returned. It is submitted by the learned counsel for the petitioner that the petitioner is ready to return the said amount of Rs.63,500/- within two months and Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforementioned stand of the petitioner,

Patna High Court Cr.Misc. No.28439 of 2015 (2) dt.24-07-2015 2/2 let the above named petitioner be released on provisional anticipatory bail for three months in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Bhagalpur in connection with Gopalpur (Rangra) P.S. Case No. 248 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.

The provisional bail will be confirmed by the learned court below on deposit of Rs.63,500/- by the petitioner through bank draft before the learned court below within three months. The aforesaid bank draft will be released in favour of the informant by the learned court below.
