JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,385,387 and 353 of the Indian Penal Code.

It is alleged by the informant being an Assistant Teacher of Middle School, Dhuriya Kalasan that the petitioner entered into the school, assaulted the teachers, cook and threw utensils. It is submitted by the learned counsel for the petitioner that the headmaster of the school, namely, Hemchandra Bandhu and the petitioner are on litigating terms and Mutation Revision Case No. 50 of 2014 has been preferred by Hemchandra Bandhu against the order passed in Mutation Appeal No. 23 of 2012-13 in favour of the petitioner. Patna High Court Cr.Misc. No.29837 of 2015 (2) dt.14-07-2015 2/2 present FIR, hence it is submitted that the present case has been lodged at the behest of the headmaster of the school. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Udakishunganj, Madhepura in connection with Chousa P.S. Case No. 98 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
