JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-11-2019 This application, for grant of anticipatory bail, arises out of Barachatti P.S. Case No. 107 of 2002, disclosing offences under Sections 147, 148, 149, 341, 323, 307 and 302 of the Indian Penal Code.

Allegation against the petitioner is that she and one co-accused caught hold of the deceased and another co-accused assaulted him by means of Balan causing his death. Submission of learned counsel for the petitioner is that she is a lady and has falsely been implicated in this case and there is no allegation against her of assaulting the deceased and at that time she was minor but she could not take such plea. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances, this application is allowed. Let the petitioner,

Patna High Court CR. MISC. No.48789 of 2019(3) dt.16-11-2019 2/2 above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisinoal Judicial Magistrate, Sherghati, Disstrict -Gaya, in connection with Barachatti P.S. Case No. 107 of 2002, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
