====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 23-08-2023 Heard learned Counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner is apprehending his arrest in connection with Obra P.S. Case No.149 of 2023 dated 30.03.2023, lodged under Sections 341, 323, 504, 506, 325, 307 & 34 of the Indian Penal Code.

3. As per prosecution case, the F.I.R. has been lodged against two named accused persons including the present petitioner. The allegation against the present petitioner is that he has caused injury upon the head of the informant.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. He further submits that the petitioner and informant both are full brothers, due to land dispute this problem has arisen and for the

Case No.149 of 2023 and Obra P.S. Case No.150 of 2023 by the informant and petitioner sides respectively. He also submits that due to the said dispute injury took place from both the sides. Learned counsel submits that the antecedent of petitioner is clean.

5. Learned A.P.P. for the State opposes the prayer for bail.

6. In the present facts and circumstances, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar (Aurangabad), in connection with Obra P.S. Case No.149 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
