JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-09-2024 The present writ petition has been filed seeking the following relief:- "1.That the petitioner above named prays for issuance of appropriate order/orders, direction/directions or writ/writs, preferably in the nature of Mandamus, commanding and directing the Respondent authority concerned, to grant license for Dharm-Kanta for 50 Tone (20 Kg. x 2500 weight), for which petitioner has applied through online mode and has deposited the required fee etc. and
Patna High Court CWJC No.12943 of 2024(2) dt.09-09-2024 2/3 even purchased required Kilowatts and fulfilled/completed all the required formalities for the same, but till date license of DharmKanta has not been granted to the petitioner for reasons best known to the Respondent authority."

At the outset, the learned counsel for the petitioner seeks a direction upon the respondent no. 2 to consider and take a final decision either way upon the application filed by the petitioner for grant of license for Dharam-Kanta on 16.11.2023, by the online mode.

Per contra, the learned counsel for the respondentState submits that in case the aforesaid application has been filed by the petitioner and is still pending consideration, the same would definitely be disposed off within a stipulated time frame.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the respondent no. 2 i.e. the Controller-cum-Joint Director of Agriculture (Weight & Measure), Department of Agriculture, Bihar, Patna to consider the aforesaid application of the petitioner, in case the same has actually been filed and is still pending consideration and pass a reasoned and a speaking order within a period of six weeks of receipt/production of a copy of this order.
