JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22.11.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 363, 366A, 354B and 342 of the IPC.
The petitioner is named in the first information report and according to prosecution case itself, victim was recovered from the house of the petitioner by the informant himself.
The victim has levelled allegation against the petitioner that it was the petitioner who forcibly took her and confined her in his room but submission on behalf of the petitioner is that the petitioner is a handicapped young chap and, as a matter of fact, father of the victim had taken
Patna High Court Cr.Misc. No.66030 of 2018 (2) dt.22-11-2018 loan from father of the petitioner and when father of the petitioner demanded his money from father of the victim, father of the informant lodged this case.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Benipur, Darbhanga in Alinagar P.S. Case no. 85/2018.
