The petitioner apprehends his arrest in a case registered for offence under section 393 IPC and 37 (b)(c ) of the Bihar Prohibition and Excise Act, 2016.
It is submitted on behalf of the petitioner that coaccused Monu @ Rahul Kumar @ Radhey Sarkar @ Rajiv Ranjan on whose disclosure petitioner has been made accused, has already been allowed bail by this Court vide order dated 19.4.2018, passed in Cr.Mis.No. 22880 of 2018. Petitioner has no criminal antecedent except for Pirbahore Police Station Case No. 218 of 2017 in which he is already on bail. In the facts of the case, prayer for anticipatory bail to the petitioner is allowed. In the event of arrest/surrender within a period of four weeks from today, let the petitioner as
Patna High Court Cr.Misc. No.65657 of 2018(2) dt.13-12-2018 2/2 mentioned above be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Special Judge Excise, Patna in Special case no. 8126 of 2017, Rupaspur Police Station Case No. 414 of 2017 on the following conditions:- One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he/she is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner and The Petitioner will be well represented on each date and if he/she fails to do so on two consecutive dates, his/her bail will be liable to be cancelled.
