Petitioner, who is in custody, seeks bail in connection with Ara Nawada P.S. Case No. 588 of 2018 registered for the offences punishable under Sections 379/411/414/419/420 of the Indian Penal Code. Allegation against petitioner is of recovery of stolen motorcycle from his possession which was driven by the petitioner.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. The alleged stolen motorcycle has been recovered from the house of Bholu Singh with which the petitioner has no concern. Nothing has been recovered from the conscious and constructive

Patna High Court Cr.Misc. No.63362 of 2018(2) dt.26-10-2018 2/2 possession of the petitioner and has been made accused due to high handedness of police. Petitioner is in custody since 31.08.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara, in connection with Ara Nawada P.S. Case No. 588 of 2018.
