Petitioner, who is in custody, seeks bail in connection with Belaganj P.S. Case No. 268 of 2018 registered for the offences punishable under Sections 30(d) of the Bihar Excise Amendment Act, 2016 and under Section 2 (e)/335(b)/18/42 of Mahua Flower Niyamabali.
Allegation against petitioner is recovery of 50 kilograms Mahua Flower from a vehicle which was driven by the petitioner.
It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case. Nothing has been recovered from the possession of the petitioner. He is only the driver of the said
Patna High Court Cr.Misc. No.63981 of 2018(2) dt.31-10-2018 2/2 vehicle. He has no criminal antecedent. He is in custody since 03.09.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya in connection with Belaganj P.S. Case No. 268 of 2018.
