JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 21-12-2021 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. At the very outset, the learned counsel for the petitioners submits that the petitioner No.2, Rohit Kumar, has been arrested, as such, the prayer for anticipatory bail for petitioner No.2 is hereby dismissed as withdrawn. So far as anticipatory bail of petitioner No.1 and 3 are concerned, this application, for grant of anticipatory bail, arises out of Dandari Police Station Case No. 75 of 2020, disclosing offences under Sections 341, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code.

The allegation against the petitioner No.1 is that he

Patna High Court CR. MISC. No.9042 of 2021(2) dt.21-12-2021 2/2 inflicted Khanti blow on the head of Parwati Devi. The injury report of Parwati Devi shows that she has sustained injuries, which are simple in nature caused by hard and blunt substance. As such, let the petitioner No.1, Tuntun Rajak, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Raghubir Prasad, learned Additional Chief Judicial Magistrate-V, Begusarai, in connection with Dandari Police Station Case No. 75 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

So far as bail application of petitioner No.3 is concerned, he inflicted repeated lathi blow on the Jay Jay Ram Yadav and the injury report of Jay Jay Ram Yadav shows that he has sustained grievous injuries, as such, the anticipatory bail application of petitioner No.3 is hereby rejected. sanjeev/- (Nawneet Kumar Pandey , J) U T
