Mr.Amitesh Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 13-01-2023 Heard learned counsel for the petitioner and learned APP for the State through video conferencing in view of the COVID 19.

The petitioner apprehends his arrest in connection with Kanhauli P.S. Case No. 168 of 2021 for the offence registered under Sections 341, 323, 376 and 506 of the Indian Penal Code.

As per the allegation, the lady has alleged that the petitioner entered her home and on the threat of knife committed rape. Later upon raising alarm, he fled away but his mobile and other belongings remained in the house. Accordingly, the FIR was lodged.

Considering the direct allegation of rape against the petitioner by the lady, this Court is not inclined to grant him

Patna High Court CR. MISC. No.53323 of 2022(2) dt.13-01-2023 2/2 relief which is accordingly, rejected.
