ANJANA MISHRA ORAL ORDER 17-11-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Case No.C2-203/16 for allegedly having committed the offence under Sections 47(A) and 54 of the Excise Amendment Act, 2016.

Learned counsel for the petitioner submits that the alleged recovery is not from the conscious possession of the petitioner, rather it was recovered from a room beside left to the door of the house of one Md. Bochaiyan.

Considering the entire facts and circumstances and that the petitioner has no other criminal antecedent of similar
