The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 363, 366(A) and other Sections of the Indian Penal Code.

The father of the victim made allegation that the petitioner kidnapped his minor daughter and took her Alwar, Rajasthan. The victim appeared and made her statement under Section 164 of the Cr.P.C. The victim disclosed that she was loving Gaurav and she took him to Delhi.

It is submitted that the victim did not state anywhere that the petitioner kidnapped her. From the order of the learned Sessions Judge, it appears that the victim was 17 years on the date of occurrence according to the Bihar School Examination Board

Patna High Court Cr.Misc. No.29441 of 2015 (2) dt.28-07-2015 2/2 certificate. The victim herself did not made any allegation of her kidnapping.

Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Parihar P.S. Case No. 51 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
