JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Civil Lines P.S. Case No. 193 of 2019 registered for the offences punishable under Sections 448, 323, 341, 354B, 384, 504 and 506 of the Indian Penal Code. Prosecution story is that the petitioner while the informant was sleeping along with her family members entered inside the house and tried to outrage her modesty and on alarm when people came he fled away.

Submission of learned counsel for the petitioner is that the informant is his own Bhabhi aged about 65 years and the present case has been lodged with respect to transaction in running of vehicle. It is also submitted that though petitioner has no knowledge that he has criminal antecedent but learned

Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail of the petitioner on the ground that petitioner has criminal antecedent and he has tried to outrage the modesty of the informant.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Civil Lines P.S. Case No. 193 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
