2. At the outset, Mr. Kumar Kaushik, learned Advocate for the petitioner fairly contended that during the pendency of the writ petition, the petitioner who was put to a departmental proceeding under rule 43(b) of the Bihar Pension Rules, 1950 came to be culminated vide order as contained in Memo No. 1638 dated 30.08.2023; whereupon the petitioner has been accorded all the benefits under the head of gratuity and the remaining pension. It is also contended that other retiral/admissible dues of the petitioner have also been paid to

3. The aforesaid facts have also been reiterated by learned Advocate for the State.

4. Now, the only grievance of the petitioner is, he has not been accorded the interest over the delayed payment despite the petitioner has been exonerated in a departmental proceeding by imposing no punishment. However, after some arguments, the petitioner seeks permission to withdraw the writ petition with a liberty to raise the contention of interest over the delayed payment before the authorities concerned.

5. In view thereof, the present writ petition stands disposed of with the liberty aforesaid.
